Terms of Membership of Simiverse
These are the terms of being a member of Simiverse agreed upon when you create an account using the official registration link on the website.
This agreement is between “You” the content creator and “Us/We” Simiverse.

You/Your/The Creator: Refers to the individual content creator who has agreed to these terms and holds an account with Simiverse.
Us/We/Our/Simiverse: Refers to Simiverse, the content creation community operated by James & Thomas.
Your Content: Any media or material produced by you, including but not limited to Twitch Streams, YouTube Videos, Shorts, Livestreams, blogs, written articles, images, and audio recordings.
Likeness: Refers to your look, voice, style, branding, name, catchphrases, avatar or in-game characters, social media presence, likeness in merchandise, recorded performances, photographs, artistic creations, written content, and digital likeness.
Associate Member/Member/Partner: Any creator affiliated with Simiverse, whether through basic membership, advanced partnership, or special collaboration agreements.
Competing Communities: Any group, platform, or organization offering services or content similar to Simiverse, including promotional services for simulation-based content, unless explicitly approved by Simiverse.
Third-Party Platforms: External services where your content may be published or distributed, including but not limited to Twitch, YouTube, Discord, and social media channels.
Simiverse Channels: Official platforms operated by Simiverse, including but not limited to the Simiverse website (Simiverse.net), Discord server, social media accounts, and any other digital or physical media controlled by Simiverse.
Content Submission: The process of uploading, sharing, or providing your content to Simiverse through official channels, such as the Simiverse clip submission portal or by direct sharing on Simiverse-operated platforms.
Verification: The process of confirming that you are the rightful owner of the content and channels associated with your Simiverse account. This may include actions such as commenting on specific videos or using unique phrases during livestreams.
Force Majeure: Circumstances beyond Simiverse’s control that prevent the fulfillment of obligations, including natural disasters, wars, government restrictions, technical failures, and other unforeseen events.
Account Termination: The suspension or closure of your Simiverse account, either at your request or at Simiverse’s discretion for breaches of these terms.
Indirect Monetary Gain: Revenue generated by Simiverse from content containing your likeness through means such as ad revenue or platform monetization that does not involve direct sales of your personal branding or content.
Our Responsibilities as a community
We will in our best efforts promote your channel through various methods as seen fit by Simiverse.
We endeavour to create a safe and enjoyable environment for our members to be a part of. We will take no responsibility for content posted on our website or other social channels by other associate members/members/partners.
Any member found to be posting content of which breaks obvious laws shall be removed at the discretion of Simiverse.
Simiverse reserves the right to report any members to the appropriate authorities for posting illegal content on any of their social media platforms.
Any member found to be posting inappropriate content shall be given a warning, and should the behaviour continue, that user shall be removed at the discretion of Simiverse.
Simiverse can decide at its discretion what is appropriate.
Disallowed topics for arguments are set out in Annex A.
You will commit to being an active participant in provided channels such as groups, discord (If above the join age of 18), forums & events.
We will use your content responsibly in order to promote your content, livestreams, channels and so forth.
Simiverse can use your content responsibly for whatever reason it deems appropriate. This can include but is not limited to; YouTube Videos (Compilations, shorts, etc), Highlight reels provided to streamers for their use (for example: A highlights reel, may be played during ‘Taking A Break’ scene in a streamers broadcast)
Simiverse may seek your permission to upload a clip longer than 300 seconds.
We will endeavour to not upload single clips, with the exception of short form content where the Simiverse Logo will be added.
We can edit your content for the purposes of redistribution in any way we deem appropriate.
Edits to your content may include but are not limited to following; Adding the Simiverse Logo, shortening or lengthening clips you have provided to us via (‘ simiverse.net/submit-clip ‘), including your content with others in any context, taking sound clips from any of your content for use amongst the community,
The above 1.5 & 1.5.1 include the use of your uploaded content to any of our social media channels, including but not limited to our website (Simiverse.net), our discord server, social media channels or any other Simiverse operated channel.
We will endeavour that all of our members are verified as the owners of their respective channels. Simiverse reserves the right to withdraw verification to ensure that continuity of account ownership is clear and that we ensure that the account claiming to be the owner of the respective channels/accounts are true.
Simiverse may ask you to verify that you own the respective channels that you are claiming to be yours, this can be done in a number of ways, such as but not limited to; Commenting on a selected video, or in a livestream chat a specific phrase to verify that you hold the account ownership.
Simiverse holds the rights to distribute your likeness in any way it deems fit. This can include, but is not limited to, your look, voice, style, branding, name, catchphrases, avatar or in-game characters, social media presence, likeness in merchandise, recorded performances, photographs or images, written content, artistic creations, and digital likeness.
We will NOT use your likeness for excessive financial gain, example; we will not put your avatar onto a mug and sell it though our own channels without elicit permission from you the creator.
We may sell products on your behalf, but this would not be done without written permission from you, and a clear monetary sharing agreement in place.
We endeavour to never use your likeness in a way that could be viewed as detrimental to your endeavour as a creator, mistakes do happen, we will take due care when reposting content/your likeness.
We will reserve the right to retain indirect monetary gains such as AdSense on YouTube from content that contains your likeness and/or original content.
Your Responsibilities as an associate Member/Member/Partner
You will comply with requests from Simiverse to place our product/branding in reasonable places on your content. Example but not limited to, placing a Simiverse banner in your Twitch.tv panels section below your livestream and/or adding Simiverse.net to your links in your YouTube channel.
Simiverse may at its discretion create personalised banners for use on your channels to aid in the cross-promotion processes.
If you fail to comply with any reasonable requests from Simiverse, we may at our discretion close your account and you will lose your acquired member status and you may or may not have permission to reopen your account.
Assist Simiverse with reasonable requests for content, so that we can perform our duties as set out in clause 1.4 and onwards.
Failure to comply with clause 2.2 may result in your account not being featured within our promotional activities.
Consistent failure to comply with clause 2.2 may result in account closure as the discretion of Simiverse.
You must be seen to promote Simiverse in responsible ways, such as set above in clause 2.1, other forms of promotion may include but are not limited to, a request from us to post specific content directly relating to Simiverse, a request from Simiverse to leave an honest review for promotional material.
Simiverse will not be held responsible for any comment of which you make about our brand or any other service that Simiverse provides.
Simiverse will reserve the right to hold you accountable for detrimental actions towards Simiverse.
You must cross promote other Associate Members, Members and Partners of Simiverse.
Valid forms of cross promotion include but are not limited to, Discord server announcements when another creator is going live, posting of events hosted by Simiverse and/or its creator Associate Members, Members or Partners.
Failure to cross-promote fellow creators working with Simiverse is a direct failure to comply with the rules and may result in your account being suspended.
While we promote creators channels, Simiverse will not promote other creators discord servers and/or websites (unless created by Simiverse).
Promoting your own Discord server in any official Simiverse channel, will result in account termination, and return to membership will be held at the discretion of Simiverse.
You must endeavour to support fellow creators by any reasonable non-monetary effort.
Clause 2.5 could be but not limited to, following their accounts, watching when they are live, engaging with their content when posted, engaging with fellows while they are online via Simiverse channels, such as but not limited to Discord, website groups, forums and in any other reasonable way.
Should we provide you with any content, artwork, training or any other Simiverse creation, you have the right to use these materials in a way that does not ‘expose/leak’ any Simiverse exclusive content onto the internet in places that it shouldn’t be.
Simiverse may provide you with links to private hosting services such as but not limited to Google Docs, Dropbox, a website resources page. You must take every reasonable effort to ensure that documents, videos, images, or any other Simiverse provided content must not be released without the explicit permission of the creator and/or Simiverse.
Releasing Simiverse created/creator content without the explicit permission of Simiverse will result in your account being suspended, and you may or may not have the ability to open an account with Simiverse again, this will be up to our Discretion.
You agree that you will not join any competing communities to Simiverse without the elicit permission of Simiverse.
A competing community is classified as but not limited to; A community focused on delivering simulation content. A community focused on delivering partnership for financial gain A community focused on delivering similar services to Simiverse.
You agree that Simiverse will hold all promotional authority, and self-promotion within the Simiverse provided channels is strictly prohibited.
If you wish for a self-promotion, you may ask a Simiverse staff member, and they will, at their discretion, create a promotional piece of content in line with internal promotion policies.
Failure to comply with Clauses 2.7 and 2.7.1 will result in immediate account suspension.
Content Ownership, Intellectual Property Rights & Copyright
Simiverse does not own any intellectual property that you create, you by agreeing to these terms and conditions are allowing Simiverse to distribute and use any intellectual property you create both previously and during the time of your membership with Simiverse.
You agree to let Simiverse use your content as set out in these terms of service.
You agree that there is no expiration of use for Simiverse of your content that you create both prior to joining and while you are a member of Simiverse.
Should you leave Simiverse, we will no longer be able to use any future content that you create, Simiverse will be able to use content that you created during and previous your membership.
Simiverse will not remove content from public viewing after you end your membership with us. An example including but not limited to; We post a short/highlights video containing a piece of your content.
Simiverse will endeavour to ensure that your content is not used after you terminate your account with us. To avoid any mistakes, please email info@simiverse.net detailing your account closure.
From the date of receipt of your cancelation email, we will endeavour to not use your content created past this date.
We will also endeavour to not use previously created content; however, we will reserve the right to.
Simiverse creations are wholly owned by Simiverse and may not be disputed. These creations may use your likeness and intellectual property as set out in these terms.
Simiverse creations are not to be redistributed without elicit permission from Simiverse. Expect in the context of a review within a livestream, not an uploaded video/vod. Example: You may stream watching our created content, only if it is a small portion of a larger stream. Ie Between action sections in your own stream (Cruise during a Flight Sim stream or a natural break in any other stream).
If you share Simiverse content during a stream of your own, Simiverse will not be held accountable for any Copyright infringements, or any other action that may be taken against you for playing a copyrighted piece of content that Simiverse holds the right too.
You may not revoke the permission you give Simiverse to use content as set in these terms.
You are solely responsible for ensuring that all content you create and share through Simiverse complies with the terms, conditions, and community guidelines of third-party platforms, including but not limited to Twitch, YouTube, Discord, and any other relevant services.
Simiverse accepts no responsibility or liability for: Any content strikes, bans, suspensions, or removals imposed by third-party platforms due to your content. Any copyright infringement claims, intellectual property disputes, or other legal actions arising from the use of third-party materials in your content. Any loss of revenue, followers, or reputation resulting from actions taken by third-party platforms against your content.
By agreeing to these terms, you acknowledge that it is your responsibility to verify that your content meets the policies and requirements of any platforms on which it is shared or published.
Simiverse reserves the right to suspend or terminate your account if your content violates the terms of third-party platforms, resulting in reputational or operational harm to Simiverse.
Liability and Indemnification
Simiverse accepts no liability for any damages (financial, reputational, etc) arising from the use of your content or likeness.
Simiverse accepts no liability for any damages of any kind arising from your use of our content regardless of source.
Should you the creator of content, infringe on a third party’s copyright/intellectual property, Simiverse accepts no responsibility for any action taken against you, the creator.
Simiverse accepts no responsibility for any security breaches on any of Simiverse provided channels, including but not limited to, Discord, Website, Social Media Channels, Email.
Simiverse recommends the use of two factor authentication, and safe online practices, and will not be held responsible for any loss of data due to your security practices.
Simiverse collects and stores personal data in accordance with our Privacy policy found on our website at https://www.simiverse.net/privacy-policy
Simiverse accepts no liability for data breaches for data held in accordance with aforementioned policy.
Simiverse will take “reasonable technical and organizational measures” to protect data, in line with GDPR.
Dispute Resolution
Should a dispute arise between you and Simiverse, these are the terms and processes that apply.
Account Closure.
Should Simiverse exercise it’s right to close your account for breach of terms as set out in this document, you have the right to appeal by emailing the team at info@simiverse.net with a detailed explanation to the reasoning behind the failure to comply with the terms as set out here.
Simiverse holds the right to remain silent, and no reply from your request is guaranteed.
Simiverse, may offer you the ability to rejoin the network after proper due diligence has been completed, proper due diligence may include but is not limited to, a formal meeting between both parties, a thorough investigation into the action that led to the account termination.
After an investigation concludes, should Simiverse decide to hold an investigation, this does not guarantee your ability to retain your account with Simiverse.
You are not permitted to attempt to register any new account with Simiverse should your original account be suspended.
Simiverse reserves the right to suspend any account, for any reason while an investigation is being conducted.
Simiverse accepts no liability for loss of earnings should an account be closed during an investigation or suspended for breach of terms.
Simiverse does not guarantee any earnings to be paid from an ongoing sponsorship/marketing program should your account be suspended for any reason.
Should Simiverse decide to reopen your account after the period of closure, any earnings that would have been allocated to you during this time are not guaranteed.
Simiverse reserves the right to take further action should your actions, resulting in your account suspension cause loss of earnings to Simiverse.
Should the dispute arise from a breach of clause 1.2.2 Simiverse shall not respond to any form of contact.
Amendments to These Terms
Simiverse reserves the right to alter these terms at any time, for any reason.
You will receive due notice of any change to these terms, you shall receive this notice via email from info@simiverse.net.
If you continue to use any Simiverse system as a user after the date provided in the notice of change email, you are automatically accepting these new terms and will be held responsible for any breach of the new terms.
Continued use is counts as but not limited to.
Continued use of Discord.
Continued use of Member only areas of the website.
Continued compliance of requests from Simiverse.
Continued Cross Promotional activities.
Should you object to new terms, your account will be suspended on the date that the new terms come into effect.
To notify Simiverse that you don’t want to comply with any altered terms, you must email info@simiverse.net stating that you wish to close your account prior to the new terms coming into effect. Your account will subsequently be closed the day prior to the new terms coming into effect.
Simiverse will not be held liable for any loss of earnings due to account closure for non-compliance with any new terms.
Force Majeure
Simiverse shall not be held liable for any failure or delay in fulfilling its obligations under these terms due to circumstances beyond its reasonable control. This includes, but is not limited to: Natural disasters (e.g., earthquakes, floods, fires, storms) Acts of God, war, terrorism, civil unrest, or political instability Government actions, regulations, or restrictions, epidemics, pandemics, or public health emergencies Power outages, internet disruptions, or failures of telecommunications networks Strikes, labour disputes, or shortages of materials or labour Any other unforeseen events that prevent Simiverse from performing its obligations
In the event of a force majeure situation, Simiverse will make reasonable efforts to notify affected members and resume services as soon as it is practical. However, Simiverse shall not be obligated to provide compensation for any loss of earnings, opportunities, or content delays resulting from such events.
You acknowledge that force majeure events may affect the availability of Simiverse platforms, promotional activities, or other services without prior notice.
Jurisdiction and Governing Law
These terms and any disputes or claims arising from them shall be governed by and construed in accordance with the laws of Scotland.
By agreeing to these terms, you consent to the exclusive jurisdiction of the Scottish courts for the resolution of any disputes, claims, or legal proceedings related to your membership with Simiverse.
Any legal action taken against Simiverse must be filed within the jurisdiction of Scotland, and Simiverse reserves the right to pursue legal action in the same jurisdiction should you breach these terms.
